Good evening, today is Friday, December 9th, and I’m Hector Montemayor-Perez.
A Dollar General Store may still be built on property at 1911 North State Highway 118 near Alpine High School despite a denial of a replat by City Council last month.
City Attorney Ron Ponton issued a press release Friday saying the city legally annexed the property in the summer and no action was needed to approve a replat.
He said state law and city ordinances say the plat did not need to be approved because it conformed to city and state ordinances and laws.
The release said that once the annexation had been completed, the city had no right to vote to deny the replat and the property owner now can sue council members for damages.
Ponton told us the law only requires a replat if it is to be subdivided into individual residential lots. It did have smaller lots but they were not destined for residential use.
Ponton said with the annexation complete, the city cannot turn down the plat just because it does not like the business.
Mayor Catherine Eaves said the state keeps taking away rights of the city and there is nothing council or staff can do.
And Building Official Andrew Devaney said he is reviewing their plans and as long as they meet code, he cannot deny a permit
Dollar General Public Relations said it is in what it called “due diligence phase” for a new Dollar General location but have not committed to doing so just yet.
Family Magic Night is still going through the weekend at the Granada Theatre with shows until Sunday every night.
Friday will be at 7 p.m., Saturday’s Show will be at 6 and Sunday will have one show at 2 and one at 6.
Family Magic Night came to Alpine in October with juggler Michael Goudau and magician Jacob Jax, but they brought a new act with Aerialist Kristi Toguchi.
Toguchi: “I went to a few of the art galleries and saw all these beautiful paintings and glass artwork and ceramic work, and I was very surprised to see all of this art here and I was very inspired.”
Every day they’ll perform a family-friendly show full of nutty tricks, crazy stunts, magic tricks, contortion, areal performances and more.
Goudau said the opening of the Granada theatre allowed the shows to reach their fullest potential.
Goudau: “Just because it’s big and beautiful and fantastic. It’s going to be a great show we’re really excited about this show.”
Although the show cateres to kids, Jax said that even parents and college students can get a laugh and be amazed.
Jax: “I saw a magician when I was a young kid and learned that’s a beautiful thing you can do for people and I want kids to come to the show and start learning magic because it’s a beautiful way to interact with people.”
The Granada is selling tickets at $10 online or $15 at the door for children six and under and $15 online or $20 at the door for adults.

This year’s Annual Live Nativity will be at 7 each evening from December 19 to 21 at the stable area next to Kokernot Lodge.
To participate in the performance, be at Kokernot Lodge between 6 and 6:30 each night of the performances.
Coffee, hot chocolate and cookies will be served to members of the audience and participants after each night’s performance.
Director Karen McGuire invited those interested in helping unload or setup for the Nativity to call 386-3071.
McGuire reminded audience members to also dress warmly and bring lawn chairs or blankets to be more comfortable while viewing the performances.

El abogado de la ciudad, Ron Ponton, emitió un comunicado de prensa el viernes diciendo que la ciudad anexó legalmente la propiedad en el verano y que no se necesitaba ninguna acción para aprobar un replanteamiento.
